Terms of Use

These Terms of Use ("Terms") apply to your use of the Bookashoot website at bookashoot.co (the "Platform"), operated by Mohammad Sami, an individual based in Dubai, United Arab Emirates ("Bookashoot", "we", "us"). By creating an account or using the Platform you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Platform.

1. What Bookashoot does

Bookashoot is an online marketplace that helps customers find independent photographers in the UAE, see their portfolios and prices, send booking requests and chat with them. Bookashoot is an intermediary only. We are not a photography studio, we do not employ the photographers listed on the Platform, and we are not a party to any agreement between a customer and a photographer.

2. Bookings, contracts and payment

• A booking made on the Platform is a request. A booking is only agreed when the photographer confirms it (or, if the photographer uses instant booking, when it is automatically confirmed).
• The contract for the photography services is directly between the customer and the photographer. The photographer is solely responsible for the services they provide, and the customer for paying for them.
• Payment is arranged directly with the photographer. Bookashoot does not currently process, hold or collect payments, deposits or tips, and does not issue tax invoices for photography services.
• Prices shown on the Platform are estimates set by the photographer. The final price, deposit (if any), cancellation and refund terms are agreed between the customer and the photographer.
• No platform fee: Bookashoot currently charges no fees to customers or photographers. If we introduce fees in the future, we will tell you in advance and they will not apply to bookings already agreed.

3. Accounts

• You must be at least 18 years old and able to enter into a binding contract to create an account.
• You must give accurate information and keep it up to date, keep your password secure, and are responsible for activity on your account.
• Photographers confirm that they hold any licence, permit or registration required under UAE law to offer their services, and that they are responsible for their own taxes (including VAT, where applicable).

4. Your conduct

When using the Platform you agree not to:

• break any UAE law, including laws on privacy, cybercrime, media content and consumer protection;
• post content that is false, misleading, offensive, defamatory, indecent or that infringes anyone's rights;
• photograph, publish or share images of people without the consent required by UAE law;
• harass, threaten or discriminate against other users, or send spam or unsolicited advertising;
• create fake accounts, impersonate anyone, or post fake bookings or reviews;
• try to access other users' accounts or data, or interfere with the security or operation of the Platform.

5. Content and intellectual property

• Photographers own their photos. Uploading a portfolio image does not transfer ownership to Bookashoot.
• By uploading content (such as portfolio images, profile photos, videos and text) you give Bookashoot a non-exclusive, royalty-free, worldwide licence to host, display, resize and reproduce that content on the Platform and in promoting the Platform (for example, showing your profile on our homepage), for as long as it remains on the Platform. You can end this licence by deleting the content or your account.
• You confirm that you own, or have permission to use, all content you upload, and that it does not infringe anyone else's rights. You also confirm you have the consent of any identifiable person shown in it where required.
• The rights in photos delivered to a customer after a shoot (for example, how the customer may use them) are agreed between the customer and the photographer.
• The Bookashoot name, logo and website design belong to us and may not be used without our permission.

6. Reviews

Customers may review a photographer after a completed booking. Reviews must be honest, based on a genuine experience and follow the conduct rules above. We may remove reviews that break these Terms, but we do not check or endorse reviews and they reflect only the opinion of the person who wrote them.

7. Disputes between users

If something goes wrong with a booking, please first try to resolve it directly with the other party. You can also report a problem through the Platform; we may look into it and take action on accounts that break these Terms, but we are not obliged to resolve disputes between customers and photographers, and we cannot issue refunds because payments are made directly between you.

8. Suspension and termination

You can stop using the Platform and ask us to delete your account at any time by contacting hello@bookashoot.co. We may suspend or close an account, or remove content, if we reasonably believe it breaks these Terms or the law, puts other users at risk, or if required by a competent authority.

9. Our liability

• The Platform is provided "as is". We try to keep it available and accurate, but we do not guarantee it will be uninterrupted or error-free.
• Because we are not a party to agreements between customers and photographers, we are not responsible for the quality, safety, legality or delivery of photography services, for payments between users, or for anything a user says or does.
• To the maximum extent permitted by UAE law, Bookashoot will not be liable for any indirect or consequential loss, or for loss of profit, data or opportunity. Nothing in these Terms limits liability that cannot be limited under UAE law.

10. Changes to these Terms

We may update these Terms from time to time. We will post the new version on this page and, for significant changes, notify you by email or on the Platform. Continuing to use the Platform after a change means you accept it.

11. Governing law

These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. The courts of the Emirate of Dubai have jurisdiction over any dispute arising from these Terms or your use of the Platform.
